Safe Harbor Litigation
The legal team
representing the plaintiffs is seeking relief for all
individuals represented. We are not naïve however and know it
will be a long, time consuming and expensive process. We have
therefore created a “Safe Harbor” for all affected taxpayers
while the class action litigation is pending. We know that the
final decision will not be made at the lower court level. Each
of our cases will undoubtedly work their way through the Florida
intermediate appellate courts to the Florida Supreme Court and
even ultimately to the United States Supreme Court. We have not
undertaken such a challenge lightly. As Abraham Lincoln said, “A
lawyer’s time is his stock in trade.” All we have to give is the
best of our time and effort to this cause knowing that the end
game to this litigation will not be played out for several
years. During that time you will continue to be called upon to
pay your taxes.
To provide maximum benefit and insurance, the legal team representing
the individual Plaintiffs and class members offer a “Safe Harbor” for
all affected taxpayers who join our legal action. If you join our action
you will be in the best position to recapture unconstitutional excessive
taxes paid by you. This will insure you maximum tax relief. Should the
courts declare SOHA unconstitutional, they most likely will only allow
future relief and not allow for the recovery of excessive taxes paid in
the past, except for those persons who have joined in our action or
otherwise specifically preserved their objection to SOHA in court. It is
our strong legal view that taxes paid by existing litigants must be
refunded. Those taxpayers who join in the existing lawsuit will become
“existing litigants” as opposed to potential class member litigants, and
thereby will be protected for taxes paid by them while the litigation is
pending.
